Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any right or remedy you may have under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded. All references in these Terms and Conditions to “no refunds” refer to refunds for change of mind, personal circumstances, scheduling conflicts, non-attendance, or failure to complete, and do not affect your rights where a consumer guarantee has not been met. |

ONLINE COURSES POLICY |

This policy applies to all courses delivered by FMS Training entirely online (“online courses”), where all training and assessment is completed via our online learning platform with no on-site attendance required. By booking an online course, you acknowledge and agree to the following terms in addition to all other applicable sections of these Terms and Conditions. Cancellation and refund arrangements for online courses are governed by the Online Course Refund Policy. Identification and USI requirements for accredited online courses are set out in the Course Requirements section. Licensing courses (e.g. Forklift, Order Picker, etc.) cannot be completed entirely online, as practical training and assessment must be conducted in person in accordance with WHS QLD High Risk Work licensing requirements. FMS Training offers both accredited and non-accredited online courses. The course information page will identify whether a course is accredited or non-accredited before you book. Accredited online courses result in nationally recognised certification. Entry requirements relating to age, Unique Student Identifier (USI), identification, English language, and digital literacy apply, as set out in the Course Requirements section. Non-accredited online courses are open to any person, with no minimum age, USI, identification, or residency requirement. These courses do not result in nationally recognised certification, and no Statement of Attainment is issued. If a candidate or group does not attend their scheduled training or assessment, this will be treated as non-attendance.
Upon enrolment, candidates are granted immediate access to our online theory content, instructional videos, and training resources. As this provides substantial value in the delivery of our service, bookings are non-refundable other than as provided in our Cancellations and Reschedules Policy and our Australian Consumer Law statement. If a candidate wishes to rebook after a non-attendance:

LIMITED COURSE CAPACITY |

To maintain a high standard of training, support our candidates effectively, and ensure a high pass rate, FMS Training strictly limits each licensing course to a maximum of 10 participants per course. This limited capacity means that once your booking is confirmed, your place is reserved exclusively for you. As a result, cancellations, reschedules, or non-attendance prevent us from offering that place to another candidate and impact our ability to deliver training efficiently and maintain consistently high pass outcomes. This is why our Cancellations and Reschedules Policy requires at least five (5) working days’ notice, why fees are forfeited for cancellations at short notice and non-attendance, and why full course fees apply to rebook if you do not attend as scheduled. |
SUBSTITUTE CANDIDATE POLICY |

As an alternative to cancellation or rescheduling, FMS Training allows for a substitute candidate (such as a colleague or fri end) to attend in place of the originally booked candidate.
These requirements are in place to ensure training places are managed fairly and, for licensing courses, to comply with WHS Q LD regulations for scheduling High Risk Work Licence assessments. |
COOLING-OFF PERIOD POLICY |

FMS Training does not offer a statutory cooling-off period, except where required by law. Cancellation and reschedule requests for all courses are managed under our Cancellations and Reschedules Policy, and refunds for online courses are managed under our Online Course Refund Policy. For online courses, access to digital course materials is provided immediately upon confirmation of enrolment. By booking an online course, you request and consent to immediate access to the digital course materials, and you acknowledge that once access ha s been provided the service has been substantially delivered. Nothing in this policy affects your rights under the Australian Consumer Law. Please refer to the Australian Consumer Law sta tement at the beginning of these Terms and Conditions. |
LATECOMER/S POLICY |

Punctuality is essential to ensure the best learning experience for all participants and to comply with strict assessment conditions set by Workplace Health and Safety Queensland (WHS QLD). FMS Training reserves the right to refuse entry to any candidate who arrives late to their scheduled training or assessment. Candidates must arrive on time for both training and assessment sessions. Any candidate who arrives late on the day of their assessment will not be permitted to sit the exam. This will be treated as non-attendance, and all fees will be forfeited. These requirements are in place to ensure compliance with WHS QLD regulations and to maintain the integrity and safety of the assessment process. Please refer to our ‘Non-attendance Policy’ for further details. |
INSUFFICIENT IDs OR INCORRECT FOOTWEAR POLICY |

All licensing course candidates are required to provide three (3) forms of identification, including at least one photographic ID, and must wear appropriate closed-toe footwear (e.g. joggers, trainers, or sneakers). Thongs, sandals, or open footwear are not permitted. Failure to present the required IDs or wear appropriate footwear on the day of training or assessment will be treated as non- attendance. Please refer to our ‘Non-attendance Policy’ for further details. |
CLOSED BOOK POLICY FOR THEORY ASSESSMENTS |

All theory assessments, including Knowledge and Calculations exams, are strictly conducted as closed book exams. This means candidates are prohibited from using any external materials, including notes, books, or electronic devices, during the assessment. The use of mobile phone calculators is not permitted. Only a basic calculator, without memory storage capabilities, is allowe d for use during the assessment. By participating in the training and assessment process, candidates agree to adhere to this policy. Any violation of this rule will result in the immediate termination of the assessment, and the candidate will be required to reschedule at their own expense . |
ORAL ASSESSMENT POLICY |

FMS Training offers one-on-one oral assessments for candidates with Language, Literacy, and Numeracy (LLN) support needs, such as individuals with learning disabilities including dyslexia, dysgraphia, or processing disorders. This assessment format is conducted by a WHSQ-approved assessor for the relevant course, and is specifically designed for candidates who may have difficulty with reading and writing but can still demonstrate a strong command of spoken English, which is essential for safety and compliance in high-risk work environments.
If a candidate is deemed Not Yet Competent (NYC) in any part of the oral assessment, including Knowledge, Calculations, or Performance, a $350.00 (incl. GST) oral assessment fee will apply to organise another assessment, which includes an additional training day, which is required under WHS QLD’s regulations for scheduling High Risk Work Licence assessments. |
ASSESSMENT RESIT AND REASSESSMENT POLICY |

Candidates who are deemed Not Yet Competent (NYC) in any part of their assessment (Knowledge & Calculations or Performance) will be required to complete additional training and pay the applicable reassessment fees.
Assessment Scope
All reassessments must be booked and completed within six (6) months of the original course date. After this period, reassessments will not be offered, and the candidate will be required to enrol in the full course again at the full course fee to ensure compliance with the latest WHS QLD theory and practical standards. |

ADDITIONAL TRAINING / SUPPORT POLICY |

FMS Training is committed to offering flexible support for individuals with disabilities and diverse learning needs. If the trainer determines that a candidate with a disability or diverse learning needs requires additional study or practical experience before their initial assessment, the candidate may be invited to attend an additional day of training.
Note: Candidates who do not achieve a competent result on their first assessment attempt will be subject to the Assessment Resit and Reassessment Policy, which requires both the mandatory extra training and the assessment resit fee ($350). By booking any licensing course, you acknowledge and agree that you are willing and able to study and prepare prior to the course start date, as all instructional videos and training materials are provided upon enrolment. This allows ample time to review and be ready for your training and assessment. |

Any credit issued to a candidate’s account must be redeemed within six (6) months from the original course start date. Credits not used within this timeframe will be deemed expired and will no longer be valid. |
CANCELLATIONS AND RESCHEDULES POLICY (Effective 13 July 2026) |

FMS Training is a small, family-operated Registered Training Organisation. All of our courses, both licensing and non-licensing, are delivered in small sessions with strictly limited places, and trainer, assessor, plant, and training resources are committe d to your booking from the time it is confirmed. In addition, for licensing courses, candidate details must be lodged in advance with Workplace Health and Safety Queensland (WHS QLD) to confirm each scheduled High Risk Work assessment. Once your booking is confirmed and the course date approaches, a cancelled place cannot be resold at short notice. For these reasons, the followin g notice requirements apply to all cancellation and reschedule requests, for all courses. Requests made at least five (5) working days before the course start date:

No cancellation or reschedule requests will be accepted over the phone. All requests must be submitted in writing by contacting FMS Training via email. These requirements are in place to manage our limited training places fairly, to reflect the genuine costs a small training organisation incurs when a confirmed place is cancelled at short notice, and, for licensing courses, to comply with WHS QLD regulations for scheduling High Risk Work Licence assessments. By proceeding with a booking, candidates or a company representative acknowledge and agree to this policy in full. Please ensure you have booked into the correct course and dates to avoid any unnecessary fees. Nothing in this policy affects your rights under the Australian Consumer Law- please refer to the Australian Consumer Law statement at the beginning of these Terms and Conditions. |
ONLINE COURSE REFUND POLICY |

Upon confirmation of your enrolment in an online course, you are immediately granted full access to the digital course materials, which constitutes substantial delivery of the service. Accordingly, refunds will not be approved for change of mind, incorrect course selection, personal or work circumstances, or failure to commence or complete the course, once access to the digital course materials has been provided. Important Notes:
Your Rights Under the Australian Consumer Law Nothing in this policy excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Aust ralian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded. Where FMS Training fails to comply with a consumer guarantee – for example, if the course is not delivered with due care and skill, is not fit for its stated purpose, or is materially different from its description – you may be entitled to a remedy, which may include a repair, replacement, re-supply, or refund, depending on the nature of the failure. This policy applies only to the extent permitted by law and does not limit those rights. |
CANCELLATIONS DUE TO EMERGENCY, UNFORESEEN CIRCUMSTANCES, OR ILLNESS OF A TRAINER |

If a trainer or assessor becomes unexpectedly unavailable due to emergency, illness, or unforeseen circumstances (such as nat ural disasters), FMS Training will offer candidates the following options:
FMS Training will notify affected candidates as promptly as possible and will do its best to minimise any disruption caused by such cancellations. Please note: This refund or reschedule option applies only when a cancellation is initiated by FMS Training. If a candidate wishes to cancel or reschedule their booking for any other reason, the standard Cancellations and Reschedules Policy applies. |
PAYMENT AND BOOKING CONFIRMATION |

All fees must be paid in full prior to course commencement. Bookings are not confirmed until payment is received. For company invoicing of any course, the following are required before your booking can be processed:
Once we receive these documents, we will process your booking and issue an invoice. FMS Training is committed to issuing Statements of Attainment (SOA) and all certification documentation promptly upon a candidate’s successful completion of their assessment. However, where full payment of all applicable fees has not been receiv ed, FMS Training reserves the right to withhold the issuance of certification, including Statements of Attainment, until the outstanding balance is paid in full. Upon confirmation of full payment, certification will be issued without undue delay, in accordance with our obligations under the Standards for Registered Training Organisations 2025. If you are dissatisfied with any aspect of our services, including a decision made under these Terms and Conditions, you may lodge a complaint or appeal with FMS Training in writing via email to info@fmstraining.com.au. Complaints and appeals are managed in accordance with our Complaints and Appeals Policy, available on our website or on request. We will acknowledge your complaint promptly, manage it fairly and efficiently, and keep you informed of the outcome. Appeals against assessment decisions must be lodged within ten (10) working days of receiving your assessment outcome. This process does not restrict your right to pursue other remedies available to you, including under the Australian Consumer Law. FMS Training acknowledges the importance you attach to information that identifies you (personal identifiers such as your nam e, address, date of birth and email address). We are committed to protecting and managing the personal information you choose to share with our organisation. By providing this information, you can deal with our organisation in confidence that your personal information will only be used for the purposes described to you, will be held securely, and will be disposed of appropriately when it is no longer required. We collect and use personal information to administer your enrolment and deliver training and assessment services. This includes using your contact details to communicate with you regarding course bookings, confirmations, pre-course materials, reminders, scheduling changes, attendance (including non-attendance), and assessment outcomes. We may also use and disclose your personal information to meet our legal and regulatory obligations as a Registered Training Organisation, including Unique Student Identifier (USI) administration and reporting of training activity and outcomes to relevant government bodies in accordance with the National VET Data Policy and AVETMISS reporting requirements. Where your enrolment is arranged or funded by an employer, job provider, or other authorised representative, we may disclose limited information to that party where reasonably necessary to administer your booking and training. If you authorise FMS Training to create a USI on your behalf, we will only collect the information required for that purpose and will destroy any personal information collected solely for that purpose as soon as practicable after it is no longer needed, un less we are required by law to retain it. Where we hold your USI, we take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification, or disclosure. Student information may also be viewed by authorised government officials during regulatory or audit processes. |
NATIONAL VET DATA POLICY PRIVACY NOTICE |

As a Registered Training Organisation (RTO 45189), FMS Training is required to collect and report certain personal informatio n about students undertaking nationally recognised training. During the enrolment process, students are provided with the mandatory NCVER VET Data Privacy Notice (Schedule 1) in accordance with the National VET Data Policy, which is available at: https://www.dewr.gov.au/national-vet-data/vet-privacy- notice. This notice explains how student information is collected, used, disclosed and reported for vocational education and training purposes. The notice is provided in addition to this Privacy Statement. |
UNIQUE STUDENT IDENTIFIER (USI) POLICY |

Under the Student Identifiers Act 2014 from 1 January 2015, all students undertaking nationally recognised training delivered by a Registered Training Organisation (RTO) must have a Unique Student Identifier (USI). A USI is a unique ten-character alphanumeric reference number that creates a secure online record of an individual’s nationally recognised training and qualifications attained in Australia. A USI gives students access to their training records and results via their personal USI account at https://www.usi.gov.au/. MANDATORY REQUIREMENT A valid USI is mandatory for enrolment in any nationally recognised qualification, unit of competency, skill set, or accredit ed course delivered by FMS Training. Students acknowledge that providing a USI is a legislative requirement under the Student Ident ifiers Act 2014. FMS Training cannot:

The personal details provided to FMS Training must match exactly with the details used to create the USI. FMS Training will v erify all USIs through the USI Registry System prior to issuing any Statement of Attainment or Qualification and prior to reporting training activity to the National VET Data Collection (AVETMISS). PERMISSION TO CREATE, LOCATE OR VERIFY A USI Where a student is unable to provide their USI, they may give written permission for FMS Training to:
Written consent must be explicit and recorded in accordance with USI privacy requirements and applicable legislation. FMS Training will not create, locate, verify, or access a student’s USI without documented written permission from the student. FAILURE TO PROVIDE A USI If a valid USI is not provided:
Students acknowledge that providing an incorrect or invalid USI may delay certification and reporting outcomes. |
